A list of certificates issued in the County aforsaid, with respect to the said Duty, bewteen the 25th March, and the 1st October 1785, pursuant to the Act of the last Session of PArliament granting a Duty on such Certifciates. The will of John Duckering farmer of Horsington.
'This is the last Will and Testament of me John Duckering of Horsington in the County of Lincoln Farmer . First I nominate and appoint James Turner the Younger of Waddingworth in the said County of Lincoln and Timonthy Overton of Horncastle in the same County Grocer Trustees and Executors of this my Will. And I give and bequeath unto my dear Wife Elizabeth Duckering All my furniture plate linen china books pictures wearing apparel and all other my household effects absoluetly. And I give and bequeath to my natural daughter Mary Duckering Semper the legacy or sum of four hundred pounds to be paid out of the estate herein after devised to my daughter Elizabeth Duckering and I give and having to my daughter Elizabeth Duckering and to her heirs for ever all that my freehold estate situate at Horsington in the County of Lincoln and now in my occupation and also all that right estate and interest of and in a certain close piece or parcel of land called the great Cots Herd close situate lying and being in Bucknall in the County of Lincoln and all other myreal estate whatsoever and wheresoever subject to the payment of the legacy or sum of four hundred pounds herein before bequeathed to my said daughter Mary Duckering Semper and I hereby charge the same estate with the payment of the said legacy accordingly. And I give and bequeath to the said James Turner the younger andTimonthy Overton their heirs executors administrators andassigns All the principal sum of four hundred pounds (and all interest to be due at my decease) secured on a certain mortgage from one William Makey of Gainsborough in the said County Farmer together with the said mortgage and all other securities I may possess for the same upon the trusts herein after declared concerning the same that is to say Upon trust to pay the annual interest and proceeds thereof to my said Wife Elizabeth Duckering during her life and after her decease upon trust to collect and get in the said principal sum of four hundred pounds and there out to pay to my said son John Duckeing sum of three hundred and fifty pounds and to pay the residue thereof to my said daughter Elizabeth Duckering and for the better enabling my said Trustees to recover the same I give and devise unto the said James Turner the Younger and Timonthy Overton all the hereditamenst comprised in or affected by the said securities tohold the same unto the said James Turner the Younger and Timonthy Overton or the survivor of them or their heirs executors or administrators of such survivor according to myestate and interest therein respectively and subject to such equity of redemption as may at the time of my decease exist under or by virtue of the said mortgage And I declare that the receipt or receipts of the said James Turner the Younger and Timonthy Overton and the survivor of them and the heirs executors administrators or assigns of such survivor for any money payable under this my Will shall be an effectual discharge or discharges for the sum or sums of money therein respectively expressed to be received And all the rest residue and remainder of my personal estate whatsoever and wheresoever not herein before disposed of I give and bequeath unto my daughter Elizabeth Duckering her executors administrators and assigns And lastly hereby revoking all former and other Wills by me hereto fore at any time made I publish and declare this to be my last Will and Testament In witness whereof I have hereunto set my hand and seal the twenty fourth day of December in the year of our Lord one thousand eight hundred and forty one John Duckering Signed sealed published and declared by the said Testator as and for his last Will and Testament in the presence of us who in his presence and in the presence of each other have here unto subsribed our names as witnesses hereto the word fifty on the first side being first substituted for the word eighty Rt Clitherow Mary Clitherow. 'Whereas I John Duckering of Horsington in the County of Lincoln Farmer made and duly executed my last Will and Testament in writing bearing date on or about the twenty fourth day of December one thousand eight hundred and forty one. Now I do hereby declare this writing to be a Codicil to my said Will and I direct the same to be annexed thereto and taken as part thereof. Whereas I have in my said Will given to my son John Duckering the sum of three hundred and fifty pounds to be paid to him after the decease of my Wife. I now revoke such bequest altogether and direct my Trustees named in the said Will to pay to my said son the interest and annual proceeds of three hundred pounds for and during the term of his natural life and after his decease to pay and divide the said sum of three pounds equally amongst his children in case he shall leave any and in case he shall die without leaving any children then I direct my said Trustees to divide the said sum of three hundred pounds between the said Mary Duckering Semper and Elizabeth Duckering or their issue such issue taking only their parents share .
'And whereas I have given by my said Will the interest of four hundred pounds to my Wife now I revoke such bequest and in lieu thereof I direct my Trustees to pay her the annuity or clear yearly sum of thirty pounds so long as she shall continue my Widow And whereas I have by my said Will given to my natural daughter Mary Duckering Semper the sum of four hundred pounds now I hereby revoke such bequest and in lieu thereof I hereby give and bequeath to her the said Mary Duckering Semper the sum of three hundred and fifty pounds to be paid her out of the estate devised to my daughter Elizabeth Duckering at the times following that is to say one hundred pounds within six calendar months after my decease and the remaining two hundred and fifty at the decease of my said Wife. In witness whereof I the said John Duckering have to this Codicil set my hand and seal this seventeenth day of June one thousand eight hundred and forty three. John Duckering. Signed and sealed by the above named John Duckering and by him published and declared to be a Codicil to his last Will and Testament in the presence of us who have here unto subscribed our names in the presence and in the presence of each other. 'At Lincoln on the eighteenth day of June 1844 Administration (with the Will annexed) of the personal estate of John Duckering late of Horsington in the County of Lincoln Farmer deceased was granted to Elizabeth Duckering the daughter the residuary legatee named in the Will. James Turner the Younger and Timonthy Overton the Executors therein named having renounced the probate and execution thereof The Testator died on the 13th December 1843.'
Elizabeth his daughter was appointed the administrator of her father's will, which was declared on the 18th of June 1844 not total more than £450. See paperwork. (David Daniels 15.6.96)
