'Lucy of Kirton-in-Lindsey, Lincolnshire, widow died 27th May1952. Probate to Harry Albert Fisher and Robert Elmhirst Duckering, coal merchants manager. Effects £14,559 10s 7d.' (Michael)

'THIS IS THE LAST WILL of me LUCY DUCKERING of Kirton-in-Lindseyin the County of Lincoln widow.
1. I REVOKE all other Wills and testamentary dispositions by meheretofore made.2. I APPOINT my son Robert Elmhirst Duckering and Harry AlbertFisher of Kirton-in-Lindsey aforesaid solicitor's managing clerk executors and trustees of this my will.
3. I DECLARE that the expression my trustees shall in this mywill and in any and every codicil hereto save where such interpretation is precluded by the context include the trustees or trustee for the time being of this my Will.4. I REQUEST my trustees to give effect to any wishes I may express in any memorandum or memorand a signed by me and deposited with my will in regard to the disposal of any of mychattels and personal effects but nothing herein or in any such memorandum or meoranda contained shall operate to create a trustor impose any binding obligation on my trustees with respect to the said chattels and personal effects or otherwise fetter their absolute power herein given.
5. I BEQUEATH the following pecuniary legacies (free of duty)
(a) to my trustees two sums of two thousand pounds each upon the trusts here in after declared thereof respectively.
(b) to each of my trustees who shall prove my Will and act inthe trusts thereof the sum of fifty pounds.
(c) to my niece Constance Mary Birkett for her many kndnesses tome the sum of two hundred pounds.
(d) to my former maid servant Olive Holt the sum of fiftypounds.
6. I DIRECT my Trustees to stand possessed of one of the said legacies of two thousand pounds UPON TRUST to invest the same in their names and to accumulate the yearly income by similiar invetsments until my grandson Edward Elmhirst Duckering shall attain the age of twenty one years or die under that age and if he shall attain that age thereupon to transfer to him both the original fund and the accumulations but if he shall die under that age then to dispose thereof as part of my residuary estate.
7. I DIRECT my trustees to stand possessed of the other of thesaid legacies of two thousand pounds UPON TRUST to invest the same in their names and to accumulate the yearly income by similiar investments until my grand-daughter Victoria Anne Mary Duckering shall attain the age of twenty one years or under that age and if she shal attain that age thereupon to transfer to her both the original fund andthe accumulations but if she shall die under that age to dispose thereof as part of my residuary estate.
8. I BEQUEATH the following specific legacies (free of duty):-
(a) to my son the said Robert Elmhirst Duckering all my plate and plated articles.(b) to the said Victoria Anne Mary Duckering my jewellery.
(c) to my daughter in law Edith Annie Duckering my linen.
(d) to the Church Army my wearing apparel.
9. SUBJECT thereto I DEVISE AND BEQUEATH all my estate andeffects both real and personal to my son the said Robert Elmhirst Duckering absolutely. IN WITNESS whereof I have hereunto set my hand this twentieth day of January one thousand nine hundred and forty seven.

Notes for Edward Elmhirst (Spouse 1)
Edward attended Brigg Grammar School from 1889 to 1891. He is listed in a book, ‘Brigg Grammar School’ by F Henthorn published 1959.

In the 1905 Kelly's Lincolnshire Directory it records Edward as a wine and spirit merchant. (Mark 8.97)

'1. Parry & Co., Wine and Spirit Merchants and tobacco. This was run by three brothers, one of whom, Charles, opened a wholesale off-licence wines and spirits shop in Manley Street, Scunthorpe. Unfortunately it did not flourish. The one in Kirton did, and is still trading today, albeit under different ownership. Before the Parry Brothers had this business it belonged to Edward Elmhirst DUCKERING - brewer, wine and spirit merchant. He was a benefactor to this town. (See notes on Town Hall and War Memorial.) The DUCKERINGs were a large family and at one time formed the Town's cricket team. They were known locally as the Ducks and an opposing team the Drakes. As well as a brewer and wine merchant in the family we have: Arthur - Coal merchant; Arthur Richard - Malster and seed merchant; Frederick - Coal,cake corn and salt merchant; Charles Elmhirst - a farmer at Cliff Farm. The present generation of DUCKERINGs, although born in the town, do not reside here.' (Kirton in Lindsey -Historical Aspects, Lincoln Library ref. L Kirk 9, p 71 - Mark1.6.98)

In his father's will Edward's occupation is given as 'coal merchant' - 1927. (Michael) In his his Uncle's will, Arthur Richard, Edward's occupation is given as 'corn merchant' - 1932. (Michael) I am assuming that it is this Edward. In Edward's will it refers to his occupation being that of a 'Coal and Corn Merchant' - 1942. (See file)

Edward Elmhirst DUCKERING of Kirton Lindsey, wine & spirit merchant, served as a school governor for the Kirton-in-Lindsey Endowed School from 1918 - 1931. (Mark 1.6.98)

See picture of Spirit bottle. The seller added this additional comment - Great, I'm pleased it's gone to a good home, more so as your an actual descendant. As a said in my description I believe the labels being rather plain small and in black and white are probably emergency War time paper shortage labels. They are genuine and not just stuck on a plain bottle. The bottle in my opinion is a good bit older what with the double collar lip suggests to me to be late Victorian early Edwardian. No doubt re-used old stock again due to shortage of all raw materials during the Wars.

'This is the last Will of me Edward Elmhirst Duckedring of Kirton-in-Lindsey in the Coutny of Lincoln Coal and Corn Merchant. 1 I revoke all other Wills and testamentary dispositions by me heretofore made. 2 I appoint my wife Lucy Duckering and my son Robert Elmhirst Duckering executors and trustees of this my Will. 3 I declare that the expression my trustees shall in this my Will and in and and every codicil hereto save where such interpretation if precluded by the context include the trustees or trustee for the time being of this my Will. 4 I bequeath to my said wife Lucy Duckering all articles of personal or domestic or household use or ornament free of duty. 5 I bequeath to the Parochial Church Council of the parish of Kirton-in-Lindsey aforesaid the sum of one hundred and twenty five pounds (free of duty) to beheld by them upon trust to invest the same and apply the yearly income thereof for the benefit of such poor inhabitants of that parish as the said Parochial Church Council shall select. 6 as to all the rest of my estate and effects both real and personal I devise and bequeath the same unto my trustees upon trust that my trustees shall sell, call in and convert into money such parts thereof as shall not consist of money and invest the moneys arising from such sale, calling in and conversion and all other moneys arising from or forming part of my residuary estate and pay the annual income of such investments to my said wife during her life and from and after her death as to the capital and income of the same investments hold the same in trust for my said son Robert Elmhirst Duckering the share of my said son to be absolutely vested on my death provided that if my said son shall die in my life time leaving issue who shall survive me and who shall attain the age of twenty-one years such issue shall take and if more than one equally between them the share which their his or her parent would have taken of and in my residuary estate if such parent had lived to attain a vested interest and provided also that if my said son shall die in my lifetime without leaving issue who shall survive me and who shall attain the age of twenty one years my trustees shall hold the same on the death of my said wife in trust for such of them my sister Kate Duckering and my half sister Eva Duckering as shall be living at my decease the share of the said Kate Duckering to be twice that of the said Eva Duckering and their respective shares to be absolutely vested on my death provided that if either the said Kate Duckering or Eva Duckering shall die in my lifetime leaving issue who shall survive me and who shall attain the age oftwenty one years such issue shall take and if more than oneequally between them the share which their his or her parent would have taken of and in my residuary estate if such parent had lived to attain a vested interest. 7 I declare that my trustees shall have a discretionary power to postpone for such period as to them shall seem expedient the sale, calling in orconversion of any parts of my real or personal estate both theunsold real estate and the outstanding personal estate shall be subject to the trusts herein before contained concerning the investments aforesaid and the rents and yearly produce thereof shall be deemed annual income for the purposes of such trusts and the unsold real estate shall be deemed to be converted as from the time of my death and be transmissable as personal estate accordingly and that as between the capital and income of my estate no apportionment of rents dividends or other periodical payments shall taken place for or in respect of the period current at my death.
